Who Will Pay My Medical Bills?

After a vehicle accident, it can be difficult to focus on your physical recovery when you are facing a pile of medical bills. At Farmer, Cline & Campbell, PLLC, one of the most common questions our personal injury lawyers hear is how our clients can handle the expenses associated with their recovery.

Who Is Responsible For Medical Bills After An Accident?

Some states have “no-fault” auto insurance laws, which means that each driver’s insurance company may cover damages, regardless of who caused the accident. However, West Virginia is a fault-based, or “tort,” state. When two (or more) parties are involved in an accident, it is up to the at-fault party to pay the other driver’s medical expenses and other damages that result from the accident.

Typically, the at-fault driver’s insurance company will cover these costs (unless the driver is uninsured or underinsured, in which case it is absolutely critical to work with a knowledgeable personal injury attorney). Even if the driver is insured, his or her insurance provider may try to limit, delay or deny payment for damages incurred in the accident.

Proving Fault Is Essential

In some cases, such as rear-end accidents or collisions caused by impaired drivers, it is very clear who was at fault. Sometimes, however, both drivers contribute to the accident, or there is a disagreement over who is at fault. To prove that the other driver was at fault, it is important to work with a law firm that can thoroughly investigate the circumstances of the auto accident, identify what happened and present the evidence to the court in a compelling way.

At Farmer, Cline & Campbell, PLLC, we have decades of experience doing just that. We are well-versed in all of West Virginia’s insurance laws and we know how to pursue every possible source of compensation for your damages. We will not rest until we have gotten the best result possible in your case.
