Criminal charges possible in West Virginia motorcyclist death

Accident investigators have determined that a truck crossed the center line while going through a curve and struck a motorcycle head-on in a crash that left a 77-year-old man dead in Kanawha County. State police troopers reported that the victim had been driving his motorcycle on Lens Creek Road. When he was approximately 5 miles outside of Marmet, the collision with the truck occurred near the intersection with Nubbie Hollow Road. Authorities have not ruled out the possibility of filing criminal charges against the truck driver.

A 911 call alerted first responders to the accident that took place at about 2:30 p.m. The Marmet Fire Department responded to the crash and closed both lanes of Lens Creek Road.

State police and the state's medical examiner also attended the accident scene to collect evidence. The road remained closed for about three hours.

Motorcyclists are particularly vulnerable to injuries when accidents happen. If a crash occurs because of a negligent driver or defective motorcycle parts, then a victim might pursue financial damages with a personal injury lawsuit. An attorney may assist the victim with this process because organizing evidence and communicating with an insurance company could be challenging tasks for a person recuperating from serious injuries or a brain injury. An attorney might look for evidence of negligence such as another driver's failure to yield or speeding. After filing court papers, an attorney may approach the responsible party or parties.
